The duo of electoral lawyers from Pablo Marçal’s campaign (PRTB), who stopped providing legal advice to the former coach less than a month after being hired, left the team after Marçal failed to present evidence to corroborate the accusation about alleged drug use by Guilherme Boulos (PSOL).
To the Estadão/Broadcastlawyer Gustavo Guedes stated that the case was just one of a sequence of facts that demonstrated the “lack of importance” that the candidate gives to legal issues.
The lawyer says that, shortly after Marçal’s accusation against Boulos, when he called his political opponent a “sugar eater” in the first electoral debate, promoted by band On August 8, the legal team sought out the businessman seeking evidence to substantiate the accusation to prepare his defense.
Boulos filed a criminal complaint with the Electoral Court, which ordered the day after the debate that Marçal delete the content in which he made the insinuations from his social networks.
“The answer we got was that there was a drug possession case against Boulos and that it would not be passed on. And, as that was not passed on until the opening of the deadline for defending this action by Boulos, we understood that we should leave the campaign, because there was no way to defend him”, said the lawyer, who confirmed that the same motivation made his colleague , Thiago Boverio leaves the campaign with him.
Guedes only found out that the target of the process was, in fact, a namesake of the psolist when he had already left the campaign, with information from the press. The report was published by the newspaper Folha de S.Paulo on August 28, stating that the action was, in fact, addressed to businessman Guilherme Bardauil Boulos for having been caught possessing marijuana, not cocaine, in 2001. Marçal’s campaign never confirmed whether this was the process that served as the basis of the accusation .
On the night of this Friday, the 4th, on the eve of the first round, the former coach published a false report on his social networks that indicated alleged use of cocaine by the federal deputy. Regarding the case, Guedes analyzes that, if the document is proven false, the São Paulo electoral court needs to act “very firmly”, but does not believe that this could lead to Marçal’s arrest, as the Electoral Code prohibits arrest on the eve of the election, except in flagrante delicto.
In addition to the lack of evidence against Boulos, Guedes cites as another example the case in which, shortly after registering his candidacy at the Superior Electoral Court (TSE), journalistic articles pointed out that the candidate left at least R$22 out of the declaration of assets. million in corporate shares.
After learning of the fact from the press, the lawyer says that he contacted Marçal’s team to understand what these companies were and assess whether, in fact, they would need to be registered. “Then I found out that soon after, when they found out about the matter, they already told the press that they would correct it, as if there had actually been an error – and an error that had not even been discussed with me”, says the lawyer, citing the case as an example of the lack of communication between the campaign and the legal team.
