Labor expands the “labor shield” by DANA with measures to care for family members and protection for domestic workers

The second vice president and Minister of Labor, Yolanda Díaz, appeared this Monday from Valencia to explain some measures of what she called “labor shield” to confront the DANA catastrophe. Along with the measures already announced by Labor, such as the priority of teleworking and justified reasons for being absent from work, Díaz has announced that measures will be approved again to care for family members as in the COVID pandemic, as well as protection for domestic workers, he stated.

“We will reissue the “MECUIDA” Pandemic Plan,” stated Yolanda Díaz. The Ministry recalls that it is about recognizing by law “conciliation rights for all people who cannot go to work for exceptional reasons” due to DANA due to caring for family members, such as children or the elderly.

Díaz recalled that the situation is exceptional given the closure of schools and damage to residences, which lead many people to need family care.

“We have to guarantee the rights of conciliation in the Valencian Community,” said the Minister of Labor, who recalled that this Me Cuida plan “considers all the possibilities of adapting the working day”: from teleworking, to the adaptation of working hours. and the reduction of the day to care. “Even a 100% reduction in working hours,” Díaz highlighted.

These rights had been claimed by the majority unions, CCOO and UGT, which, however, have always demanded that they be accompanied by paid leave, since if there are no households that cannot benefit from them. “With regard to Me Cuida, we ask the Generalitat for a supplement, for aid,” said this afternoon Ana García, general secretary of CCOO PV, who has warned that the reduction of the care day to 100% “is very good, but also economic coverage because families have to eat every day.”

Protection with retroactive effect

Furthermore, although without specifying what it will be like, Yolanda Díaz has announced that “we are going to protect the domestic workers, the invisible ones, once again.” The Ministry indicates that “domestic employees whose contracts are suspended as a result of DANA” will be protected.

The Minister of Labor has also recalled the priority of teleworking that will be approved imminently, as well as some improvements in aid to companies for ERTE due to force majeure and the four reasons that justify employees not going to work due to the DANA with the right to “non-recoverable paid leave.” Also, the willingness to reissue the “prohibited dismissal” by DANA, as happened in the pandemic.

Yolanda Díaz has insisted that, although the measures have not yet been approved in the BOE, they are “available now,” because they will be approved “retroactively from the day of the catastrophe, last October 29.”

The minister has reiterated a message of “unity”, of gratitude to social agents and of prioritizing safety and protection of life in the face of the catastrophe. “It is the absolute priority right now. Please let’s not take risks,” he insisted.
