The reform of the criminal trial must go to the Chamber on schedule, so on Friday, and collect the go-ahead from Montecitorio if not within the weekend, at the latest in the first days of next week. The government’s line, therefore, does not change. And on this point both Prime Minister Mario Draghi and the Minister of Justice Marta Cartabia are in agreement. As for the merits of the changes, relating to the second part of the bill and, in particular, to the prescription chapter, if an agreement is reached – at the moment there is no trace – with the majority forces, the outcome of the mediation it will be put in black and white in a maxi-amendment, at that point ‘armored’ by the political agreement. Otherwise, the text of the bill will be brought to the Chamber with only the changes of the government already examined and dismissed by the Council of Ministers and trust will be placed on that text, already authorized by the CDM.
At the end of another day of stalemate on justice, with the various big majority who openly spoke of “impasse, no progress” after the meeting in via Arenula with Cartabia and the group leaders in the Justice committee, in the evening there are signs of openness, which hint at a “cautious optimism”. So much so that the session of the commission, convened after the votes in the Chamber, does not start, pending the arrival of the Keeper of Seals. According to most people, this is a signal that the mediation that has been underway for days would be one step away from producing fruit. Fibrillations and conciliaboli in the groups, all gathered on the sidelines of the commission.
And there are those in the majority who insist on underlining the declarations of the Head of Justice of the League, Giulia Bongiorno, (“For us, the priority is the reduction of trial times, but at the same time also the utmost commitment to avoid that, due to the malfunctions of the judicial machinery, trials for serious crimes go up in smoke: those for mafia-type association, for association aimed at drug trafficking and for crimes of sexual violence “), interpreted by some as a clear signal of respite and easing of tension with the 5 stars. Others, however, including pentastellati, the reading is totally opposite: the League continues to raise the bar. I mean, the tension is high.
However, it should be remembered that until a few hours before the words spoken by the former Lega minister, the Lega had filtered the irritation – manifested by Matteo Salvini to Draghi himself in today’s face to face at Palazzo Chigi – for the ‘flags ‘M5s. Little time passed and Salvini himself explained: “It is right not to prescribe the Mafia trials, but for the Lega it is equally necessary to provide that even for crimes of sexual violence and drug trafficking the trials go up to At bottom”. Line reaffirmed to the Prime Minister, in a telephone call in the evening. The fact is that the indiscretion of an agreement no longer so far, even if still beyond being reached, is becoming insistent.
And so the president of the commission, the pentastellato Mario Perantoni, on the proposal of the rapporteur, the dem Franco Vazio, preferred to postpone the session until tomorrow morning, both speaking of a “close synthesis”. The summary, according to majority sources, could be reached, among other points, on the inadmissibility for mafia crimes, one of the requests of the pentastellati. Forza Italia, they explain, would not have liked it, did not expect the League’s opening, while among the dems there are those who stress that the best solution would have been to set a ceiling on the levels of judgment.
The line of the Democratic Party, however, is clear: the group leader Debora Serracchiani brought together the deputies, reiterating that for the dems it is necessary that the reform go to the Chamber in compliance with the schedule. Majority parliamentary sources observe that it was the Prime Minister himself who spent himself to clear the land, mediating between the positions of the parties, which risked stiffening in the cross vetoes, but without prejudice to the priority of the green light for reform in time short.
