The lawyers of the Administration of Justice of two Courts (First Instance and Instruction 3 of Picassent and First Instance 2 of Valencia) have issued two decrees in which the F declarelegal allegations of two of the three missing people after the Dana on October 29.
According to judicial sources to ABC, these are two men, missing in the towns of Montserrat and Pedralbarespectively that fateful afternoon. With their legal deaths, the number of total victims for floods increases to 227.
According to the same information, the voluntary jurisdiction file relative to the Third missing persona woman, appeared by her relatives after the previous ones and is being processed in a court in Requena, so the dead number will rise again to 228.
One of the two disappeared declared deceased legally is Francisco Ruiz MartÃnez, 64, who was lost track on October 29 in the surroundings of a supermarket of Mercadona in the town of Montserrat.
The other man who becomes considered the deadly victim of the Dana on October 29 is José Javier Vicent Fas, 56, who was with his daughter – also deceased – in a country house near the Barranco de Pedralba. Both were dragged by the water thrombus. His daughter’s lifeless body was found in a Swedish beach Days after the serious floods, more than 70 kilometers from where they denounced the disappearance.
Since January 29, in accordance with the regulations set forth in the Civil codethe families of the victims could request their declaration of death after three months of the tragedy. A legal figure that pursues a presumption of death to expedite the procedures and avoid more pain, through which it is allowed to open wills and obtain the rights to widow’s pensions and orphanage, as well as ask for compensation of 72,000 euros that the Government pays.
