The Superior Court of Justice of Madrid (TSJM) has declared final the sentence that acquitted to Rafael Amargo of a drug trafficking crime for which the Prosecutor’s Office asked for 9 years in prison for himsince the Public Ministry itself has not appealed to the Supreme Court.
As reported this Thursday by the office of lawyer Marcos García Montes, who represents the bailaor, the Prosecutor’s Office has finally given up appealing to the high court and therefore the sentence that acquitted him becomes final.
In the order of the Civil and Criminal section of the TSJM, the magistrates recall that on October 1 this court confirmed the acquittal of Rafael Amargo for a drug trafficking crime, confirm the invalidity of the telephone interventions.
In that ruling, which could be appealed to the Supreme Court, the Prosecutor’s appeal was dismissed, who requested to revoke the acquittal issued by the Madrid Court in May and hold a new trial before another court.
The Prosecutor’s Office announced on October 7 that it would appeal the decision of the TSJM before the Supreme Court, but on the 17th it expressly stated its withdrawal, which avokes to declare the finality of the sentence since this is the only accusation, the magistrates explain.
Last May, the Provincial Court of Madrid acquitted the dancer Rafael Amargo, the producer Eduardo de Santos and an associate of both of the crime of selling drugs of which they were accusedin a ruling that annulled wiretapping and police records.
The Court considered that, even if the listening and recordings could be taken into account, It is doubtful that a drug trafficking crime could be proven.
