The supervisor sprayed the man in the face and hit him in the thigh with a telescopic baton in Helsinki. The Court of Appeal overturned the district court’s verdict of assault.

The crime took place at the Helsinki railway station in May 2018.

The orderly supervisor and his colleagues were escorting the victim and his three companions in the platform area of ​​the railway station. It had been decided to remove these from the area after a drunken party had disturbed a nearby cafe.

The group moved towards the front a little reluctantly, and based on the video camera recording, the orderlies pushed them.

The victim then turned and shoved another law enforcement officer. The victim was sprayed with gas and beaten with a telescopic baton. The victim was brought to the ground with these means.

However, the victim was able to free himself from the policeman’s grip. The victim ran away along the platform further away from the train station.

From here a chase ensued in the wharf area. When the victim finally stopped, the police officer gassed him several times. The victim did not resist but stood still.

At this point, the law enforcement officer started hitting the victim on the back thigh with a telescopic baton.

According to the district court, the police officer’s use of force does not seem to be defensible in the situation.

Security guard denied the charge. According to him, the victim had previously used violence against law enforcement officers and at the end of the chase turned towards the law enforcement officer with the intention of using violence.

However, the video recording does not show that the victim used violence or behaved aggressively.

The District Court of Helsinki found the warden guilty of assault, and sentenced him to a 30-day fine.

Security guard appealed the verdict to the Court of Appeal. In the complaint, the warden said that he had been accepted to study at the police vocational college, but due to the legal process, he did not get a place to study.

The Court of Appeal also found the warden guilty of assault.

However, the Court of Appeal stated that the processing of the criminal case had taken quite a long time.

The crime that occurred in 2018 was not resolved in the district court until 2022. The Court of Appeal considered that the pending criminal case had negatively affected the order supervisor’s study and work opportunities.

Because of this, the Helsinki Court of Appeal decided not to sentence the police officer to punishment.
