The man had threatened the life of the district judge and prosecutor handling his case, if they did not act in the way he wanted.
The man had repeatedly harassed officials by threatening and contacting them. Some of the man’s messages had a threatening tone and direct threats.
Among other things, the man threatened to shoot, blow up, poison and cut off the head of the Espoo district court judge. In addition, he threatened to blow up the district court in Espoo.
The district court of Espoo had convicted the man of five counts of violently resisting an official, three counts of stalking and four counts of illegal threats.
Man considered that the messages had not posed a concrete threat to the interested parties. The man pleaded that some of the messages were sent with the intention of mocking and demeaning. According to his statement, the man had not tried to influence the use of public authority by officials. According to the man, the question was not about a genuine threat of violence, but about the choice of words made out of frustration and thoughtlessness.
The man also felt that the fact that his actions had been the result of mental illness and resentment towards the use of public power had not been taken into account when imposing the punishment.
The man demanded that the sentence be reduced to a fine, suspended prison term, or conditional prison sentence with community service. He further demanded that the punishment be reduced in any case.
Prosecutor demanded that the man’s complaint be dismissed.
The prosecutor considered that the messages sent by the man were clearly a matter of threatening a serious crime, and considering the accounts of the people involved, they had a justified reason to fear that their personal safety was in serious danger.
According to the prosecutor, it had to be taken into account that the man had continued his procedure even after the verdict with his submission to the Court of Appeal and other similar messages.
In its decision, the Helsinki Court of Appeal sided with the prosecutor and kept the man’s 1-year 10-month prison sentence handed down by the Espoo District Court unchanged.
