The Ministry of Labor and Social Security and the National Institute of Social Security (INSS) published a joint ordinance this week that determines that the deadline for the INSS to respond to the beneficiary’s defense, in case of suspected irregularity, will be 30 days from the date presentation of the defense.
After the period, even if the analysis has not been completed, the payment must be automatically unblocked, unless the benefit holder does not present a defense.

The insured has 30 days, after the INSS communication, to present a defense and documents that prove their right to the benefit.
Last month, the Federal Police prevented a fraud that could reach R$486 million in benefit payments.
