A student in the 3rd semester of the Law course at Insper, a university located in Vila Olímpia, south of São Paulo, was expelled from the institution on suspicion of committing racial insults against a classmate in the first semester of this year.
The case was reported and analyzed by the entity’s Superior Council, which opened an investigation and decided to dismiss the student in September. The accused, however, obtained an injunction in court and returned to classes last week.
The case was revealed by the newspaper Folha de S.Paulo and confirmed by Estadão. In a note, Insper says that the case is being processed in secret and, for this reason, it is not authorized to comment on the situation “while the action is ongoing”.
Insper students interviewed by the report, on condition of anonymity, claim that the student had committed racial insults during a class in the first semester of this year. They did not mention the names of those involved, also for reasons of judicial secrecy and in order not to expose the offended student.
According to the students, the victim was having an argument with a teacher during a class and the accused had sent the following message to a group of friends, according to the students: “Run, the monkey is pissed”.
The message ended up reaching the victim, and a complaint was made against the alleged attacker.
In a statement made to students, teachers and other employees, Insper informed about the expulsion following the conclusion of an administrative process “related to a case of discrimination” that was “conducted in two instances by collegiate bodies of the institution”.
“The matter strictly followed internal rites and was handled with the utmost speed and seriousness, guaranteeing the dignity and preservation of everyone involved”, says an excerpt from the statement, sent to the academic community on October 1st.
In the text, Insper defines itself as an institution that does not tolerate any form of prejudice and that is “committed to promoting a safe, respectful and inclusive environment, and the importance of anti-harassment practices”.
Return to school
According to the students interviewed by the report, the expelled student filed a lawsuit for moral damages against Insper and obtained an injunction to return to classes and participate again in the academic groups of which she was a member.
The return of the alleged attacker was mentioned in a statement written by InsperLaw, a law student association, of which the student was a member until she was expelled.
In the text, obtained by Estadãothe entity explains that “by preliminary court order, the member who was dismissed last week will be reinstated at the faculty”. “Despite our regulations and the University’s Code of Conduct, we were charged with the obligation to follow the court order, as was Insper”, says InsperLaw.
The students interviewed by the report criticize the student’s return and state that the feeling of the student body is one of indignation. As a form of protest, posters were posted on the walls of the university criticizing racism and reinforcing that “valuing diversity” is one of Insper’s principles of Ethics and Conduct.
