Inclusion promotes a new regulation to serve Spanish emigrants and favor their return

The Ministry of Inclusion, Social Security and Migrations prepares a new regulation that aims to improve the attention of Spanish residents abroad, facilitate their return and attract scientific and researcher talent. The regulation will update the Statute of Spanish citizenship abroad, in force for almost 20 years, which is obsolete due to the changes produced in recent decades in the profiles of the emigrant population, as announced by Minister Elma Saiz during a Meeting in New York with Spaniards living in the US.

On February 10, the Ministry will open the prior consultation process to start with the regulation development process. “This regulation will allow to meet the current needs of residents abroad, a population that, over time, has changed profiles and needs,” says the department led by Saiz in a statement.

“The objective is to collect the opinion of citizens, organizations and associations, which have a lot to say. I would like to point out that, with these regulations, we ensure compliance with article 42 of the Spanish Constitution, that is, for your rights as residents abroad, ”said the head of inclusion.

With the impulse of these regulations, Migrations wants to favor the return of “scientific, technical and researcher talent”, through the simplification of the accreditation and certification process of the research personnel through the creation of specific programs and support for scientific networks, as they detail in a press release.

The new standard, which inclusion aims to move forward during this year, also seeks to “guarantee special protection to vulnerable people who are returned in emergency situations”, such as repatrices due to military conflicts, emergency situations, minors in vulnerability situations, women victims of gender violence, etc.

A month ago, Saiz had already announced his intention to carry out a voluntary return plan of emigrants abroad. Its development will also be collected in the future regulation and will establish the concrete policies to be applied with the purpose that “those Spaniards who wish can obtain facilities to return” to their country.

The plan will include the creation of a Spanish return office to advise emigrants who wish to return to Spain and to offer “integration facilities” upon their return, according to the Ministry. Inclusion plans also go through a memory center of Spanish emigration, to “value the heritage of people who had to emigrate outside Spain during the different stages of their history.”

The regulation will also support “associationism through collaboration” with the General Council of Spanish Citizenship abroad and the advice of Spanish residents abroad, focusing on young people; and seeks to facilitate digital procedures abroad.

“Traveling is a pleasure, emigrating is a necessity and the Spaniards know it well because we have done it throughout our history. Taking into account that the existing law dates from 20 years ago, this new regulation will allow to treat this matter in a comprehensive manner and adapt the current regulations to current reality, ”said the minister.

In the last 20 years, when the Statute of Spanish Care was approved abroad, the profile and amount of the emigrant population abroad has experienced many changes. After the economic crisis of 2008, there was an increase in the Spaniards who had to leave in search of an opportunity abroad, mostly young people. If in 2009 there were 1,471,691 people of Spanish nationality residing abroad, in 2024 that figure has reached 2,908,649.
