One of the most controversial aspects when you hire a telephone operator is the permanence commitment. The main companies such as Movistar or Vodafone include it in their offers to ‘tie’ you to them, sometimes for an excessive amount of time. For this reason, the new Telecommunications Law has limited the duration of permanent contracts to 24 months. If you want to unsubscribe before that period, you will have to pay the corresponding penalty. However, in some cases you may not be able to pay.
The 24-month stay, or less if this is stated in the contract, are mandatory to leave your operator free of a fine, which can be around 250 euros or more. But customers can break the commitment earlier to change companies if the previous one has breached any agreed point in the contract.
Unsubscribe without penalty
It is important that you keep this signed agreement to review if you find yourself in any of these situations that will make you free of the penalty for the permanence commitment:
– A change in the rate.
– Charge you for calls you haven’t made.
– Activate telephone or internet services that you have not authorized
– Any point of the contract that they have not complied with.
These are more common cases than you think and the Organization of Consumers and Users (OCU) alerts on its website. You should bear in mind that the operator has the obligation to notify its customers one month in advance of any changes they make to their rates, offers, etc. If they do not meet the deadline, customers have the right to unsubscribe. If they notify you and you do not respond, it is understood that you agree with the changes. In the event that they communicate it to you and you are not satisfied with the changes, you have the right to unsubscribe without paying any penalty. The OCU explains that the withdrawal has to be effective in 2 days. Also, remember that you have the option to continue keeping your phone number and request the portability of the line.
