The Civil Guard of the Region of Murcia has investigated in the RM-3 highway, municipal district of Mazarron, to the driver of a car that was detected ccirculating in the opposite direction and under the influence of alcoholic beverages, and that finally caused a sinister road with another vehicle that was circulating on the road. The investigated person has been prosecuted as the alleged perpetrator of two crimes against road safety, for driving in a manifestly reckless manner, doing it in the opposite direction to that established, and for doing so under the influence of alcoholic beverages.
The events took place during the afternoon of last Thursday, January 7, when members of the Traffic Sector of the Civil Guard of Murcia were alerted of the possible traffic in the opposite direction to that established by the RM-3 highway, which connects Totana with Mazarrón .
Immediately a patrol of Motorists from the Traffic Sector was mobilized, which traveled to the place and after touring the affected area, they located a sinister road in the RM-3 highway at kilometer 12,900, the municipality of Mazarrón, where two vehicles were involved with one of the drivers seriously injured.
The accident had occurred when the vehicle of the now investigated wrongly joined the highway RM-3 from its entrance on the A-7 motorway, in Totana, circulating towards Mazarrón on the lanes towards Totana, traveling around 13 kilometers in the opposite direction to that stipulated, colliding frontally-laterally against other tourism, which circulated correctly, driven by a woman who was seriously injured. The now investigated was unharmed and both vehicles with considerable material damage.
After the end of the health care of the seriously injured person, who had to be transferred to the Virgen de la Arrixaca University Hospital, the actions and identification of the vehicle drivers began, verifying that one of the drivers – male , 67 years old and resident of Totana– he had obvious symptoms of drinking alcoholic beverages, for which he was subjected to the mandatory breathalyzer tests, which gave a positive result of 0.82 and 0.83 milligrams of alcohol per liter of exhaled air, more than triple the maximum rate allowed, which is 0.25 mg / liter.
The civil guards specialized in attestations found that the tourist driver had allegedly circulated in the opposite direction, for which he was finally investigated as the alleged author of two crimes against road safety, for driving in a manifestly reckless manner – in the opposite direction on the unfolded road, putting the life or integrity of other users in concrete danger – and for driving under the influence of alcoholic beverages, which was made available to the Totana Investigating Court.
As a result of the damage suffered, the vehicles involved had to be removed by the roadside assistance services, leaving that of the investigated person deposited at the disposal of the judicial authority as an instrument of the crime.
Penalties for Drunk Driving
The crime of reckless driving is contained in article 380 of the Penal Code and can be punished with prison terms of 6 months to 2 years and deprivation of the right to drive motor vehicles and mopeds for a time greater than 1 and up to 6 years.
Likewise, the crime of driving under the influence of alcoholic beverages is included in article 379 of the Penal Code and can alternatively be punished with prison terms of 3 to 6 months, a fine of 6 to 12 months, or work for the benefit of the community from 31 to 90 days and in any case with deprivation of the right to drive motor vehicles and mopeds for a time greater than 1 and up to 4 years.
The Civil Guard continues to reiterate its message to those drivers who recklessly and recklessly, despite the campaigns and warnings of the General Traffic Directorate, drive after having drunk alcohol or taken drugs, recalling that the Civil Guard Traffic Group continues to develop its specific activity of road safety surveillance 24 hours a day, especially in those activities of greater risk, where the mandatory breathalyzer and drug tests will be performed on all drivers who are reported for committing infractions, involvement in accidents or those others in which its consumption is detected in the course of other surveillance and inspection activities that are carried out.
The Civil Guard of the Region of Murcia appeals to the civic conscience of the population or other public entities to notify the telephone 062 (Civil Guard) or 112 (Emergencies) or directly to the patrols in service when they encounter anomalous situations or maneuvers irregularities that give rise to think that drivers are doing so under the influence of drugs or alcohol, in order to be able to adopt the appropriate police measures so that these vehicles are intercepted and checked if their drivers are in adequate conditions to circulate with guarantees safety, avoiding the consequent risk.
Four similar cases in 2020
This is the first case of the crime of reckless driving (driving in the opposite direction to that stipulated) in 2021 detected by the Traffic Group of the Civil Guard of the Region of Murcia. During the past year, the following similar episodes were detected:
– October 11, 2020. Investigated the driver of a car driving in the opposite direction to that stipulated in the A-7 motorway (Tarragona-Algeciras), traveling around 500 meters until colliding with another vehicle that was doing it correctly, at the height from km., 588,450, municipality of Librilla, in the vicinity of the ‘Cabecicos Blancos’ Industrial Estate.
– November 27, 2020. Investigated the driver of a car driving in the opposite direction to that stipulated in the AP-7 motorway (Crevillente-Vera), traveling around 4 kilometers until colliding with another vehicle that was doing it correctly, at the height km., 786, within the municipality of Los Alcázares.
– December 14, 2020. Investigated the driver of a car driving in the opposite direction to that stipulated in the AP-7 highway (Crevillente-Vera), traveling around 14 kilometers to, from kilometer 830 (access Las Palas-Fuente Álamo ) to kilometer 816 (Cartagena toll).
– December 20, 2020. Investigated the driver of a tourism to circulate on the N-340 road (Cádiz-Barcelona), entering at km., 599,900 in the opposite direction to that stipulated by the interior of several consecutive roundabouts, traveling from erratically for around 3 kilometers until he could be stopped by an on-duty patrol.
