In a report prepared for the European Parliament last year, it was stated that in 11 EU countries, two women or two men cannot legally be recognized as the parents of a child.

“We want to help all families and children [maiden] in cross-border situations. If you are a parent in one country, you are a parent in all countries”, the head of the European Commission Ursula von der Leyen said on Twitter on Wednesday.

“An estimated two million children may have to see that their legal relationship with their parents is denied in another Member State”, EU Justice Commissioner Didier Reynders said.

“This may be because the family has moved to a member state that does not recognize previously established parentage,” Reynders added.

The initiative requires the support of all member states, but is likely to be opposed by right-wing conservative governments in EU member states.

LGBTQ+ organizations considered the proposal positive. According to the organizations, the proposal plays a key role in the effort to achieve “uniform protection for all children in the Union”.

“Ensuring that children’s parents are fully recognized when they move within the EU is an essential condition for their interests and fundamental rights”, Executive Director of ILGA-Europe Evelyne Paradis stated.

“Legal certainty regarding recognition will reduce the serious concerns and problems that rainbow families face when traveling or immigrating within the EU.”
