His Highness Sheikh Humaid bin Rashid Al Nuaimi, Member of the Supreme Council and Ruler of Ajman, issued Emiri Decree No. (9) of 2024 regarding the Valuation and Reconciliation Committee in Ajman.
Under the provisions of the decree, the “Valuation and Reconciliation Affairs Committee in the Emirate of Ajman”, established pursuant to Emiri Decree No. (2) of 2011, will be reorganized, and its name will be replaced with the name “Valuation and Reconciliation Committee in Ajman”, and it will report administratively to the head of the Department of Land and Real Estate Regulation.
The committee is formed by a decision issued by the Crown Prince of the Emirate, and its members are chosen from those with competence and experience in the field of the committee’s specializations and tasks. The term of membership is three years, subject to renewal.
The decree stipulates that the committee is the official authority solely competent to value real estate in the emirate, and for this purpose it has the right to carry out a set of tasks and powers, including the valuation of real estate at the request of the concerned parties, in accordance with the standards and regulations approved by the Department of Land and Real Estate Regulation. Concerning the valuation of real estate in the emirate, settling disputes arising between the concerned parties, conducting reconciliation among them regarding the value of the property, in accordance with the rules and procedures approved by the Department of Land and Real Estate Regulation, approving the amicable settlement agreement between the concerned parties regarding the value of the property, and issuing the real estate valuation certificate. .
Under the decree, the committee may conduct an amicable settlement of disputes that arise between the heirs in the real estate estate, upon their request, after verifying the certificate of inheritance issued by the competent court. If the committee reaches a settlement of the dispute between the heirs, this will be proven in accordance with an agreement. A settlement is signed by the concerned parties, and the heirs must follow the procedures of the competent court in implementing the settlement agreement, in accordance with the legislation in force in the country in this regard. If it is not possible to make an amicable settlement for any reason, then the concerned parties must resort to the competent court to decide on this matter. The dispute, and the committee must issue its decisions regarding the settlement within (90) days from the date of submitting the application to it.
The decree stipulates that the committee shall issue a real estate valuation certificate, in accordance with the standards and controls approved by the Department of Land and Real Estate Regulation, and that the certificate shall be valid for a period of only three months from the date of its issuance, and the valuation certificate issued by the committee shall be fully authentic, with regard to the data recorded in it, It has not been proven to be forged by the legally prescribed methods. Any concerned party may request the revaluation of the property in question within (30) days from the date of notifying them of the valuation certificate, in accordance with the controls and procedures approved by the Department of Lands and Real Estate Regulation.
The new decree stipulates that Emiri Decree No. (2) of 2011 regarding regulating the affairs of the Appraisal and Reconciliation Committee in the Emirate of Ajman shall be cancelled, and any text or provision contained in any legislation that conflicts with the provisions of this decree shall be cancelled. The new decree shall be effective from the date of its issuance and shall be published in Official Gazette.
