The changes have passed the scrutiny of the Parliament and are effective the day after publication on the Official Gazette of the law converting the decree.
Let’s see below what the Announcements included in the Reform of the Highway Code, starting with the new rules for scooters.
New rules for electric scooters
The priority of the reform of the Highway Code, recognized by all the political forces of the Draghi Government, is to regulate the use of owned or rented scooters, with the introduction of new rules
The main novelty concerns the obligation of arrows and stops, starting from July 1, 2022, with scooters marketed in Italy they must be equipped with light indicators turning and braking on both wheels.
Those already in circulation before 1 July 2022 will have to adapt by January 1, 2024. The speed limit goes down from 25 to 20 km / h outside the pedestrian areas (in the latter the limit of 6 km / h remains).
The mini reform also introduces the Do not stop and circulation on pavements, except in the areas identified by the Municipalities. Violation of this rule will result in a fine of 84 euros. The scooters must therefore be parked correctly in the stalls reserved for cycles, mopeds and motor vehicles.
The parking areas may also be devoid of horizontal and vertical signs, provided that the GPS coordinates of their location are publicly available on the institutional website of Common. As far as sharing media is concerned, thephotography obligation of the vehicle at the end of the rental, in order to clarify the position of the scooter.
Scooter insurance and helmet
For the moment, the most anticipated rules are skipped, that is to introduce the obligation to license plate and insurance for insurance for scooters, together with that of the helmet for all. The established procedure provides that the Ministry of Infrastructure, in collaboration with those of the Interior and Economic Development, will have to evaluate the introduction of the liability policy obligation, with a specific report that will have to be sent to parliamentary committees within 180 days from the entry into force of the standard.
In the new rules there is not even the obligation of helmet feared in recent weeks, which remains the prerogative of minors only, with scooters that can only be used after completing 14 years.
The reform of the Highway Code also confirms the existing rules or that the scooters must not have seats, they must have continuous rated power not exceeding 0.50 kW, be equipped with a buzzer and speed regulator configurable and CE marked. Violation of these provisions provides for a fine of 100 euros and the confiscation of the vehicle. The penalty for two people on the scooter is 50 euros.
To be able to travel on public roads, they must be equipped with light solid white or yellow anterior of solid red light rear, rear reflector. Finally there is the obligation to circulate with reflective jacket or retroreflective straps half an hour after sunset And throughout the night.
Mobile ticket for driving
One of the main points of the reform of the Highway Code tightens the sanctions against those who use the mobile phone driving. The law prohibits the use of mobile phones, tablets, laptops even of small dimensions, notebooks and similar devices that involve even only temporarily the removal of the hands from the steering wheel.
The reform aims to increase the fine by passing to a penalty included between 422 and 1,697 euros (from the current range is 167-661 euros), plus the driving license suspension for 7 days to two months. In the event of a further violation in the course of a two-year period, one is proposed maximum fine from 644 to 2,588 euros and the suspension of the driving license from one to three months.
Newly licensed cars
The reform of the Highway Code also introduces a novelty on the cars that can drive novice drivers. Currently the law says that a young man who has just taken the driving license B cannot drive cars with a specific power, referred to the tare, higher than 55 kW / t and maximum power equal to 70 kW.
With the reform, new drivers they can drive more powerful cars if a person not over sixty-five years old sits next to them as instructor, equipped with valid driving license for the same category or higher, achieved by at least ten years.
Two-wheeled taxi velocipedes
Another amendment to the Highway Code allows the service to be carried out Taxi, hitherto reserved for cars, including the two- and three-wheeled vehicles and also velocipedes.
Disabled parking spaces and pink stalls
The reform of the Highway Code also provides pink stalls permanently or temporarily reserved to pregnant women or parents with children up to two years. To park on these stalls, the woman will need to have a special mark named “Pink permit”, but which will be governed by a specific ministerial provision, such as the relative signs.
Parking spaces for electric cars
In the stalls reserved for charging of electric cars it is forbidden to park vehicles that do not recharge and electric vehicles that remain on the space over an hour after charging is complete.
This limit does not apply between 11pm and 7am with the exception of the charging points of high power, i.e. for fast charging (greater than 22 kW and equal to or less than 50 kW) e ultra-fast (above 50 kW).
The fine goes from 41 to 168 euros if the offense is committed with mopeds and two-wheeled motor vehicles e from 87 to 345 euros with cars and other vehicles.
Free parking with blue stripes for the disabled
In the reform of the Highway Code, a rule, starting from 1 January 2022, allows disabled people to park for free on the blue lines in the event that the stalls reserved for them are occupied or unavailable, as is already the case in some cities.
Failure to show driving license
In the proposed reform of the Highway Code there is no longer mandatory to go to the police or carabinieri headquarters to exhibit the driving license if in case you are stopped without.
The existence and validity of the documents can therefore be verified by the Police by consulting the databases and public archives or those managed by state administrations.
Currently the fine without documents (registration certificate, certificate of technical suitability of mopeds, driving license, pink paper, insurance certificate) is of 42 euros (26 in the case of documents for mopeds) and there is an obligation to report to the police command of which the agents or soldiers who ascertained the violation depend, or any other command to show the original document.
Fine car hire
The rental car fines according to the reform they are now exclusively borne by the company’s customers, who will pay the sum due for offenses committed while driving.
Fines collected by the Municipalities
Municipalities and other local authorities such as Provinces with the reform will also be obliged to publish on their website, by June 30 each year, a report on the amount collected in the previous year by the violations of the Highway Code and on the way in which these sums were used.
Fine rail crossing
Speaking of fines, keep an eye on the crossing of the tracks where it is not allowed. In particular, failure to comply with the prohibition of rail crossing (because, for example, the barriers or semi-barriers are closed or are about to close) can also be detected by special devices for the assessment and the automatic detection of violations. The devices for the automatic detection of violations may also be installed by the railway infrastructure manager at his own expense.
Pink sheet valid for 12 months
Finally, the reform extends the validity of the pink sheet 6 to 12 months. With the outbreak of the pandemic there had been one extended with the prolongation of the state of emergency. Now with the reform the validity will be definitively of 12 months.
In addition, the theory exam for the driving license will be valid until three practical test attempts (the first and two repetitions). There are currently two possible attempts.
Bonus for a truck driver’s license
The reform gives the green light to the bonus for i citizenship income recipients or other social safety nets to achieve the driver’s license and become a truck driver. In fact up to June 30, 2022, young people up to 35 years and subjects who receive citizenship income or social safety nets, are entitled to a 50% refund of the expenses incurred and documented for obtaining the driving license and professional qualifications for driving vehicles intended for the road haulage of goods on behalf of third parties.
Those who carry out within one year of obtaining the driving license can benefit work or professional performance, for whatever reason, in the context of the road transport of goods on behalf of third parties, for a period of at least six months.
Sexist and violent advertising
In the reform of the Highway Code, advertising is prohibited sexist and violent on the roads and in the car. The rule says that advertising with sexist or violent messages is prohibited, or gender stereotypes offensive or messages harmful to respect for individual freedoms, gods civil and political rights, of religious belief, ethnicity or discrimination with reference tosexual orientation, gender identity, physical and psychic abilities.
