Google: AdSense case, EU Court cancels 1.5 billion fine
The EU General Court has confirmed most of the European Commission’s findings against Google/Alphabet for the abuse of a dominant position with Google AdSense for Search, but annulled the Commission’s decision to fine Google nearly €1.5 billionarguing, inter alia, that it failed to take into account all relevant circumstances in its assessment of the duration of the contractual terms which the Commission had found to be unfair.
In particular, The Court considers that the Commission has not demonstrated that the clauses in question were capable of dissuading publishers from obtaining supplies at intermediaries competing with Google or which were such as to prevent such competitors from accessing a significant part of the market for advertising intermediation in online search engines in the European Economic Area and, consequently, that those clauses were capable of producing the foreclosure effect found in the contested decision.
EU Court confirms Brussels’ €239 million fine to Qualcomm
The European Court of Justice has confirmed to a large extent the fine imposed by the European Commission to Qualcomm and set the amount at 238.7 million euros, compared to the 242 that had been decided by the Community executive for abuse of a dominant position.
