The Court recognizes the defendant an incomplete defense given the mental illness and drug use disorder he suffers
A man has been sentenced to five years in prison accused of trying to kill his mother by running her over with a car in the Murcian district of Sangonera La Seca. The prosecutor, who initially claimed for him up to nine years in prison, ended up modifying his conclusions to request a five-year sentence for the defendant, 40 years old. The Public Prosecutor’s Office demanded that the defendant be granted an incomplete defense of mental disorder, based on the mental pathology and drug use disorder that he suffers from, and this has been recognized by the Court in its resolution.
The court also imposes on the defendant an order that prevents him from approaching or communicating with his mother for a decade and a measure of freedom for a maximum term of five years. The Court emphasizes that this supervised freedom “is inexcusable to guarantee the psychological and physical tranquility of the victim.”

The attack occurred around two in the afternoon of January 22, 2019 when the accused appeared at his parents’ house in the aforementioned Murcian district. Her mother, fearing her son, did not open the door and called her husband, explaining that their son was at her house. The man arrived and her mother left the house asking the accused for money from both, begging them to leave and the accused began to insult them.
At that moment, the defendant got into the car and reversed, hitting his mother. While on the ground he told her, “You’re a son of a bitch too,” resuming his march and running over her. The defendant then left the place.
