Before Netflix, Amazon Prime or HBO arrived and established themselves as a service that the vast majority of homes had, users used websites with links to various servers to watch the movies and series they wanted, and among the most famous platforms of that type, one of the most notable is the one from SeriesYonkis.com.
Although everyone had already forgotten about this service, which in 2014 it removed all remaining links to pirated contentit seems that not everyone has done the same. It wasn’t until 2019 that a judge finally acquitted the four administrators of this platform, This case once again has a new chapter.
This is because even though several years ago those who controlled the SeriesYonkis platform were acquitted because the agreement was reached that no link harvesting activity done before 2015 is legally punishablewhich was when the Intellectual Property Law came into force.
However, the ghosts seem to have returned for these administrators, since the Entity for the Management of Rights of Audiovisual Producers (Egeda) returned to the fray and proposed reopening the case three years after it was officially closed. Provoking that in March of this year the Constitutional Court decided to admit a new claim for protection presented by Egeda where compensation of 550 million euros is claimed for the damage caused to their industry.
Now, heto Second Chamber of the high court has unanimously dismissed the appeals presented by Egeda, absolving the creators of this famous pirate website and closing 16 years later one of the most controversial and famous copyright cases ever held in Spain.
All this because the Spanish justice system has maintained again that the activity of SeriesYonkis did not constitute a crime in accordance with the regulations in force at the time.because the Intellectual Property Law did not come into force until 2015 and a year before SeriesYonkis had eliminated all the links that remained on the platform, thus rejecting any possibility of financial compensation.
