Mexico.- The Attorney General of the Republic (FGR) ‘pardoned’ soldiers allegedly involved in the Ayotzinapa casebecause he asked the federal judge cancel 16 arrest warrants that had already been turned against elements of the Army.
In accordance with Reformon August 16, the day the Truth Commission presented its report on the Ayotzinapa case, at the request of the FGR, a Toluca federal judge issued 20 arrest warrants against soldiers for the crimes of forced disappearance and organized crime.
However, on September 14, the Prosecutor’s Office went before the judge and requested in writing to cancel 16 of the 20 arrest warrants against the members of the 27th and 41st Infantry Battalions, which were rendered ineffective that same day.
None of the soldiers was detained by the FGR or the Army during the 26 days that the arrest warrants were in force, and only the warrants against four soldiers who turned themselves in the same day that the arrest warrants against their companions remained.
This means that, among the 20 soldiers who had been accused by the FGR in the Ayotzinapa case, only four are in jail: Brigadier General Jose Rodriguez Perez, former chief of the 27th Battalion; Captain Jose Martinez Crespo; the second lieutenant Fabian Alejandro Pirita Ochoa and the First Infantry Soldier Eduardo Mota Esquivel.
The highest-ranking soldier against whom the FGR gave up arresting was the Colonel Rafael Hernandez Nietoformer commander of the 41st Infantry Battalion, according to criminal case 15/2022.
