Maximilian he was not kept alive by life-sustaining treatments, and therefore was excluded from the possibility of accessing the suicide assisted in Italy since it lacks one of the requirements of the Cappato sentence of the Constitutional Court. After the public appeal to put an end to his suffering in Italy, Massimiliano chose to die in a Swiss clinic. “I am almost completely paralyzed and I also find it difficult to speak. So says Massimiliano, the 44-year-old Tuscan man suffering from multiple sclerosis, in the last video recorded before he died, today in a Swiss clinic, with suicide assisted. The text of the video was released by the Luca Coscioni association, to which the patient had turned.
“Why can’t I do it here in Italy? At home, even in a hospital, with relatives, friends, neighbors who support me. No, I have to go to Switzerland. This doesn’t seem logical to me. And so I’m forced to go away, to go away”, says Massimiliano, who had addressed, in another video, an appeal to be helped to die without suffering in Italy, his own, close to his loved ones. He could not, because he was not “kept alive by life support treatments”, therefore, he does not fall within the cases provided for by the sentence 242/2019 of the Constitutional Court on the case of Dj Fabo, who was assisted by Marco Cappato.
It is that sentence on civil disobedience by Cappato for the help provided to Fabiano Antoniani to have suicide ‘legalized’ in Italy when the sick person who requests it is affected by an irreversible pathology, a source of intolerable physical or psychological suffering, fully capable of making free and informed decisions and kept alive by life-sustaining treatments and these conditions have been verified by the National Health System. Massimiliano’s father, Bruno, who had already appeared in a video next to his son to ask to be able to put an end to his suffering in Italy, had launched his last appeal in support of his son’s freedom of choice: “He is conscious of his life. He is clear of mind. He has reached this point here because he can’t take it anymore. He can’t take it anymore. It’s a continuous suffering, day after day. It’s his will, because he has to deny this desire. The body is his, he feels what he suffers. And we can’t say no. It would only be selfishness, to make him suffer even more. I wish it were something done in Italy”.
