The previous spokesperson for Sumar, Íñigo Errejón, will appeal the decision of Judge Adolfo Carretero to provisionally archive the investigation which opened for alleged sexual assault after the complaint of actress Elisa Mouliaá. He temporary fileagreed after the complainant’s lawyer asked to suspend the investigation while she is on leave, since she will give birth soon, means prolonging the case for months until the lawyer is discharged from the doctor, at which time Errejón would be investigated again. .
The politician’s lawyer, Eva Gimbernat, announced this Tuesday that she will appeal the instructor’s decision. He will do so directly on appeal, before the Court of Madrid, instead of in reform, before Judge Adolfo Carretero himself, according to what sources from his office told ABC. Thus attempts the defense that the magistrates correct the instructor.
The reopening of the casealthough it may seem contradictory, it would be in the interest of the politician, who would thus declare as soon as possible and could defend himself against the accusations of the complainant. The archive, as agreed, instead means leaving him for months waiting for the reopening and without the possibility of doing so. Hence, her lawyer will try to get the Provincial Court to force the judge to go back, which would lead to the complainant’s lawyer, Carla Vall – who represented Jenni Hermoso in the case against the former president of the Royal Spanish Football Federation, Luis Rubiales – to appoint a substitute she trusts in case she is unable to attend the statements.
The appearances of the whistleblower Elisa Mouliaá as a witness and Errejón as an investigator were the first proceedings agreed upon by the head of the Court of Instruction 47 of Madrid. The archiving decision first implied the suspension of said statements, which were scheduled for the day before yesterday.
The complaint
On October 24, Errejón resigned from all his positions, both from the Sumar Executive and from his seat in Congress, where he also held the group’s spokesperson. It was hours after the journalist Cristina Fallarás published an anonymous testimony on her Instagram in which she spoke of sexist behavior by a Madrid politician who was described as a “monster” and “psychological abuser”. He was soon targeted and other users shared similar stories.
Once the politician resigned, actress Elisa Mouliaá published in a book by Errejón and he accompanied her to a party at a friends house. There, going up in the elevator – always according to his story, which he has not ratified before the judge – he gave her a non-consensual kiss and, after getting upset because she was dancing with another boy, he dragged her to a room, threw her down and “took off his member”. That was the content of the complaint from which Errejón will have to defend himself.
