With 350,000 lawyers registered in the state, the OAB-SP, the largest branch in the country, is a universe that rejects the entity’s partisanship, but lives with the covert dispute of political leaders for spaces of projection in the entity.
The election for the São Paulo sectional of the Order takes place this Thursday, 25. During the campaign, allies of the candidates exchanged “accusations” about the support of politicians and party connections. Postulants tend to shy away from the subject when asked about their relationship with the political world.
Despite being named by opponents as “conservative”, the candidate in the situation, Caio Augusto, has the support of PT members and PC do B lawyers to be reelected, although neither of the two acronyms has announced formal support. “He (Caio) opened spaces for all ideologies and not just for big offices. It is possible to act in order without mixing up the seasons,” said civil lawyer Arnobio Rocha.
A member of the PT, Rocha is vice president of the Human Rights Commission of the OAB-SP, an organ targeted by left-wing parties. “We represent the law, not the party,” he said.
The candidacy of Dora Cavalcanti, a criminal lawyer who worked in defense of the accused at Lava Jato, brings together prominent PT members. It has the support of lawyers such as Luiz Eduardo Greenhalgh, José Eduardo Martins Cardozo and Marco Aurélio Carvalho. Much of Dora’s campaign advice belongs to the Prerogatives group, made up of “progressives” and “anti-lavajatistas”.
Despite the large number of names linked to the PT in the surroundings of Dora, the former coordinator of the legal sector of the legend, Marco Aurélio Carvalho, classifies the participation of political parties in the OAB as “inopportune, undesirable and inconvenient”. “We don’t have support from any political party. Anyone who followed the Order’s campaign knows that we received support from all kinds of backgrounds. I can cite the former justice ministers, José Carlos Dias, Miguel Reali Júnior and José Eduardo Cardoso.”
Patrícia Vanzolini, on the other hand, has the support of Marcos da Costa (PTB), who ran for vice-mayor in 2020, on Celso Russomanno’s ticket.
“Our party is the São Paulo law firm. Our ticket is the result of Movement 133, created by us to bring the agenda of political renewal to the OAB. We want to include the OAB in the debate on political renewal, but along our own paths”, said Patrícia.
PSL
Lawyer Alfredo Scaff, on the other hand, was joined by pocket lawyers during the campaign – Carla Zambelli and Coronel Tadeu, both from the PSL. “The fact that I have the support of people who support Bolsonaro does not mean that I am a Pocketnarista”, defended the candidate.
Wanted, Caio Augusto denied that his ticket has any kind of partisan influence. “We are a group of 176 people. Probably there must be people affiliated with some party, but I don’t know how many people would be, as this was never a matter of decision-making character to make or not the ticket. What we do not admit is that, as an elected member, any type of partisan activism should be carried out within the administration”, he argued.
Car wash
Three of the five candidates for the presidency of the OAB-SP criticized Operation Lava Jato and defended a non-partisan entity in a simultaneous interview promoted yesterday by the state. For Dora Cavalcanti, Mário de Oliveira Filho and Patrícia Vanzolini, the operation violated class prerogatives. Only candidate Alfredo Scaff declined to comment on the matter. Invited, the current president of the organization, Caio Augusto Silva dos Santos, did not participate in the debate with the justification that he was in other campaign commitments.
The criminal lawyer Patrícia Vanzolini said that the conduct of the process had a “disastrous effect” for the operation itself.
Mário Filho directly cited former judge Sergio Moro, a pre-candidate for the Presidency of the Republic, and former attorney Deltan Dallagnol, who left his post at the Public Ministry. “They chose a target and to reach that target it didn’t matter what was done regarding the procedural rules”, he said. Dora Cavalcanti said that at Lava Jato the rules of the Federal Constitution were taken to the limit. “And then that pendulum came back,” he said. Alfredo Scaff was the only candidate who declined to comment on the operation for “preferring to look to the future”. “It is a criminal procedural issue already decided by the Supreme”.
Dora Cavalcanti also stated that the OAB must be non-partisan, but that it must be attentive to the defense of democracy. “Whenever themes that threaten democracy come, by our oath, the OAB must be open to debate.” Mario Filho based himself on the class oath and said he did not admit any “subversion of democracy, the democratic rule of law and human rights”.
