A question came from a reader in which he said:
The court awarded my ex-wife custody of the children, and she lives with them in her family’s house and does not pay rent. However, she is asking me for a custodial housing allowance. How can I pay her a housing allowance when she does not pay rent?

The custodial housing allowance is not waived except in two cases. The first is that the custodian is the owner of a residence in which she lives and not just that she owns it. If she rents or invests in it, the father’s custodial housing allowance is not waived. The second case is that she has housing allocated to her by the state or by someone else.
Her employer or from another spouse. As for her residence in her family’s home, the housing allowance is not waived from you, considering that her residence, even if it is long, is for the purpose of hosting according to what has been established by the judicial rulings in the state.
