The scandal Dieselgate continues to impact Volkswagen’s business. And the troubles for the German auto group may not be over, especially after an advisor to the European Supreme Court demanded that environmental associations are authorized to take the VW Group to court to challenge the installation of illegal software devices that allegedly manipulated diesel engine emissions data. If this request is accepted, there will be no good news for the German group.
The question was raised after a German court had rejected the complaint carried out by an environmental association, Deutsche Umwelthilfe, claiming its illegality in taking legal action against the VW Group. The judges of the CJEU, the Court of Justice of the European Union, could however accept the request of the consultant Athanasios Rantos referred to above and consequently overturn this decision, thus allowing all environmental groups to take legal action against German society . “The approved environmental associations they must be able to initiate legal proceedings to contest an EC type-approval of vehicles equipped with defeat devices which could be prohibited – said Rantos, adding that environmental associations defend the general interest – A device of this type can only be allowed under strict conditions “. Volkswagen trembles, the final decision of the CJEU is expected shortly.
