Denise Pipitone, the prosecutor of Marsala asks for the acquittal of Maria Angioni on trial for false declarations in the bis investigation. But the judge rejects it
The single judge of Marsala rejected the request for acquittal made by the prosecutor against the former prosecutor Maria Angioni, accused of perjury as part of the bis investigation into the disappearance of Denise Pipitone, the girl who disappeared from Mazara del Vallo in September 2004. The case was closed in December.
The request for acquittal was pronounced by the deputy prosecutor Roberto Piscitello, following some spontaneous declarations made by Angioni at the beginning of today’s hearing in front of the single judge of Marsala, Giusy Monterriccio.
“The three facts disputed to the accused have been substantially retracted” and “this is not the place to ascertain what happened in November 2004”, said the magistrate during his speech, referring to the reconstruction provided by Angioni.
Angioni trial, dismissal rejected
“The judge held that the statements cannot be a question of retraction,” said the single judge of Marsala, Giusy Monterriccio, at the end of a brief session.
“In particular, the statements made today refer to the subjective element of the crime”, continued the judge, referring to the spontaneous statements made by Angioni at the opening of the hearing.
The trial against the magistrate therefore continues, accused of false information to the prosecutor, following some contradictions contested by the Public Prosecutor of Marsala after having heard her in May 2021. The magistrate, on duty in Marsala at the time of Denise’s disappearance, has been accused – as part of the bis investigation into the case – “to have reported the false in three circumstances” in relation to misdirections during the first investigations, when he was among the prosecutors of the investigation.
