The employee said that his glasses were broken when the employee tried to stop the child from hitting and biting his colleague. During the obstruction, the child kicked the employee in the face, breaking his glasses beyond repair.
According to the employee’s compensation claim, the glasses were about three years old and cost 400 euros.
City stated that the cause of the damage was not the error or negligence of a city employee or official. Therefore, the damage was not such that the city would have been liable for damages under the Torts or Employment Contracts Act.
However, after special consideration, the city decided to compensate the employee with 200 euros.
