A couple from New York, United States, filed a lawsuit against a fertility clinic after a boy’s embryo was implanted in the process and not a girl’s, as they had initially agreed with the medical center.
Heather Wilhelm-Routenberg and her wife Robbie sued the CNY Fertility Clinic, located in Latham, New York.
According to the female couple, both had agreed that they would only have girls. This is because Heather was a victim of sexual abuse twice.so she refused to give birth to a boy.
Heather and Robbie went to the fertility clinic, where they were assured that there would be no problem with their request, since the laboratory could determine the sex of an embryo and implant it in Heather so that she would have a girl.

“We selected CNY because they agreed that we could select female embryos. We never intended to use males”, said the woman.
However, according to the ‘New York Post’, in a control at 15 weeks of pregnancy, the couple discovered that a child was forming in Heather’s womb.
“We are having a girl. Having a girl is very important to me,” Heather told the doctor, who replied, “That’s not what this says.”
According to what the couple told the aforementioned newspaper, at that time they believed that Heather had received an embryo that was not the agreed one.
“I looked at Robbie and said, ‘What if it’s not yours, who’s in my body?’ That’s when I freaked out, that’s when I felt like my body was being held hostage. I assumed it was someone else’s embryo, not a mistaken embryo of ours.“, he claimed.

However, subsequent studies found that it was the couple’s embryo and not one that belonged to another: “I was convinced the whole time that it wasn’t ours because the clinic knew we wouldn’t have a boy: it wasn’t a preference, it was a necessity.”
The woman told the ‘New York Post’ that she was deeply disappointed after discovering the result and that she was unable to connect with her son during the rest of the pregnancy or in the first months of life, since the minor was born in December 2020.

“I was so furious. He felt like a deep betrayal. How are you so wrong? They ruined something so comprehensive. The fact that there are no legal requirements for these procedures should strike fear into the hearts of all parents using fertility services.”
A year and a half later, the couple decided to sue the fertility clinic for implanting the wrong embryo.

The complaint includes 11 charges including breach of contract, medical malpractice and assault.
The clinic, for its part, stated that they are investigating the case and that they will not comment on it.
For now, Heather and Robbie told the aforementioned newspaper that their relationship with their baby has improved, but that they continue to see him and remember the error of the fertility clinic.
