A Los Angeles couple filed a complaint this Monday against a clinic specializing in in vitro fertilization (IVF) after discovering that two fertilized eggs were exchanged and that they had a daughter from another family.
When Daphna and Alexander Cardinale first saw their newborn baby in September 2019, they noticed the girl had darker skin and hair than the rest of the family, their lawyers said. “Genetic tests revealed that the baby Alexander and Daphna gave birth and raised for months had no genetic relationship to the couple,” added the Peiffer Wolf office.
According to the lawsuit, filed on Monday in a Los Angeles courthouse, embryos from two couples were exchanged, allegedly through negligence. After discovering the error, the two couples met and decided to regain custody of their genetic children, in an exchange formalized by the Court.
The error, however, left marks and caused suffering, argue the Cardinale couple in their complaint. “The birth of our daughter should have been one of the happiest moments in my life. But I was immediately shaken and confused by not recognizing her,” described Alexander Cardinale.
“When the truth came out, switching children was even more painful. Losing the child you know for a child you don’t know is an impossible nightmare,” he added.
