A temporary addition to the Communicable Diseases Act, ie Article 48a, would oblige SOTE employers to ensure that SOTE personnel do not pose a risk of infection to health care patients and social care clients.

The employer is given the right to receive information about the employee’s coronary vaccination and health information about the coronary heart disease.

If necessary, a negative corona test within 72 hours is an alternative to vaccination if the worker has a medical reason for not being able to receive the vaccine.

If the employee has no vaccination or a negative test result, the employer should primarily offer him other work under the employment contract. If this is not available, other suitable work should be offered to the employee.

If suitable work is not available or the employee does not agree to receive it, the employer would not be obliged to pay wages for the period of disqualification.

It is proposed that the provision enter into force as soon as possible. It requires a transition period of one month to allow staff to take vaccines.

The change would require a one-month transition period to allow employers to organize services appropriately and to allow non-vaccinated staff to take vaccines. However, the employer’s right to process the data would take effect immediately.
