Sentenced to sentences of more than 100 years in prison for drug trafficking and money laundering, Ricardo Cosme Silva dos Santos, known as DJ Superman Pancadão or Ricardo Pancadão, asked the Federal Supreme Court to unlock more than two million dollars seized by the Police Federal. The purpose of the release would be to pay for health treatment for the inmate, who underwent surgery in December after ingesting a toothpick.
The request was forwarded to Minister Gilmar Mendes, who has already been the rapporteur for other requests made by Ricardo Pancadão's defense. Lawyer Marcos da Silva Borges asks not only for the release of the amounts deposited in court, but also for the unblocking of his client's accounts.
To the STF, 'Pancadão''s defense narrates that he suffered 'undue seizure' of US$ 1,899,700.00, in addition to US$ 161 thousand after his arrest in 2015. The convicted drug trafficker was the target of Operation Hybris, which still captured another 39 people being investigated at the time. According to lawyers, Ricardo 'suffers restrictions on his assets, which causes numerous problems, such as the possibility of paying for quality medical treatment'.
Before appealing to the highest court, Ricardo requested the Mato Grosso Court of Justice to have his prison sentence – currently being held at the State's Central Penitentiary – replaced by humanitarian house arrest. The defense managed to obtain an injunction in favor of the defendant, but it was revoked.
According to the defense, 'Pancadão' needs treatment, 'both through surgical medical intervention and due to the need for medical treatment of other pathologies'. Lawyers maintain that, in prison, the defendant's health condition only worsens.
“The penitentiary does not provide an adequate environment to improve Ricardo’s health status, on the contrary, every day a completely unhealthy scenario is revealed and prone to clinical worsening. It is noteworthy that despite Ricardo having values (lawful, as will be demonstrated), today he is at the mercy of his own fate, without any financial condition to pay for adequate medical treatment”, records the request sent to the dean at the STF.
Report presented to the High Court recommends a period of six months for the treatment of Ricardo's pathologies. According to the document, the accused is suffering from severe steatotic liver disease, hyperferritinemia and metabolic syndrome. The first condition can lead to cirrhosis, according to doctors. In the case of the second, part of the treatment would be bloodletting.
The lawyers say that Ricardo's request is 'to live'. They argue that, if the defendant is 'unable to pay for relevant medical treatment, his life may be taken away'.
“The pathologies that affect Ricardo, if not treated, could lead to his death; he needs a healthy routine, special diet, regular practice of physical activities in a conducive environment, with regular monitoring and help from a nutritionist, endocrinologist, cardiologist and gastroenterology to promote his health and well-being, that is, an environment totally different from that in which he lives. is segregated from his outpatient freedom”, say the lawyers.
The defense requests the release of the seized values under the argument that the State cannot 'maintain the impossibility for Ricardo to enjoy what he built throughout his life, under the poor allegation that the seized values are the result of illegal activity'. “The applicant is a provisional prisoner and does not have any definitive criminal conviction against him”, emphasize the lawyers.
“It is known that the State must guarantee access to healthcare for all citizens and if the amounts seized are intended to pay for Ricardo’s medical treatment, the State cannot maintain the blockade under the allegation of persecution of guilt”, says the petition sent to Gilmar.
