Chiara Ferragni is under investigation for fraud aggravated by her impaired defence. This is the case now known to all of the 'Pink Christmas' pandoro produced by the Piedmontese company Balocco. The registration was decided by the deputy prosecutor Eugenio Fusco. Alessandra Balocco is also under investigation for aggravated fraud. This morning, January 8, the news of the change in the prosecution perspective: the Guardia di Finanza filed the first information with the Prosecutor's Office in the context of the investigation into the pandoro signed by Chiara Ferragni and produced by Balocco.
The Milan Financial Police acquired documents from the Balocco headquarters in Cuneo. According to what Ansa reports, due to a series of emails valorised in the documents acquired in the Antitrust offices, the hypothesis of a crime, yet to be formulated, could no longer be fraud in trade but rather fraud.
This morning the investigators of the Economic and Financial Police Unit of the Gdf of Milan filed a first note, which will also be followed by a series of attachments, to the deputy prosecutor Eugenio Fusco. An information regarding the pandoro case, an affair that has already led to a huge fine for the entrepreneur and for the Cuneo company, which baked the Christmas dessert “Pink Christmas”, for misleading advertising regarding charity.
In the last few hours, the Milanese investigators have evaluated the Gdf's notes which valorise, in particular, some emails already acquired by the Competition Authority, which were exchanged to plan the pandoro promotion campaign. The registration in the register of suspects came not only for Ferragni but also for Alessandra Balocco, president and CEO of Balocco Spa.
From what has been known, the investigation will have to evaluate the issues of alleged illicit profit and damage, in this case to consumers, elements necessary to establish the hypothesis of fraud. A hypothesis that is not easy to dispute, but which investigators are working on.
The hypothesis on which the prosecutor's office is working, together with the Economic and Financial Police Unit of the Guardia di Finanza, is that of “impaired defence”. A technical formula that considers the consumer who purchased the pandoro in a position of “less defense” compared to the seller for having received the misleading message electronically, i.e. through the social platforms used by the influencer with millions of followers. Now Chiara Ferragni, like Alessandra Balocco and other managers of the companies that oversaw the operation, will be heard shortly by prosecutor Fusco to provide their version of the facts and allow investigators to reconstruct the exact genesis of the contract.
