Rebate is up to 30%, valid only for civil servants who do not have assets to reimburse public coffers
The Constitution and Justice Committee of the Chamber approved this Wednesday (June 29, 2022) bill 4483, of 2020, which authorizes a discount on the salary of public servants involved in corruption cases.
The text adopted by the rapporteur Gilson Marques (Novo-SC), says that in an administrative improbity process, the judge can authorize the deduction of up to 30% of the agent’s monthly income, up to the value of the illicit enrichment or the damage caused to the public coffers. The measure is valid for civil servants who do not have assets that can be used to guarantee compensation for the damage. The employee must deposit the amount in court, which will be converted into income for the public agency.
The matter amends the Administrative Improbity Law and was analyzed conclusively. This means that the bill does not need to go through the House Plenary and can go to the Senate. The project is only withheld in the Chamber if an appeal is presented.
