Cassation, legitimate to seize noisy bars in advance
A sentence of the Court of Cassation is destined to cause discussion. The court of Trieste has decided to reject the appeal of the owner of a bar, who had seen his club closed because it was considered too noisy. For the judges – reads Il Sole 24 Ore – the closure was legitimate and the owner of the restaurant was found guilty, for having disregarded the orders of the commissioner. The bar whose operation causes unbearable noises for the people living nearby can be criminally confiscated.
It is the principle – continues the Sun – sanctioned by the Court of Cassation (sentence 35324/2021), which declared inadmissible the appeal of the owner of a business against the order of the Review Court which had confirmed the preventive seizure of the premises, by the judicial authority for the violation of article 650 of the Criminal Code. The place was a meeting place for offenders and a source of disturbance due to the noises. The regulations called for a stop to the administration of food and drinks.
