Determination of the minister of the TSE sets a fine of R$ 1,000 per day in case of non-compliance
Minister Cármen Lúcia, from the TSE (Superior Electoral Court), determined the withdrawal of the outdoors in support of President Jair Bolsonaro (PL) from the streets of the Federal District. The decision establishes that the company responsible for the material must remove them within 24 hours, under penalty of R$ 1,000 per day of non-compliance. Here’s the intact (42KB).
The action was filed by the PDT (Democratic Labor Party), acronym for Ciro Gomes. The party argued irregular electoral propaganda in favor of the candidate for reelection.
Carmen understood that, “in kind, the billboards, although they do not directly mention the represented, present content that allows them to be related to their electoral campaign, as demonstrated in the initial and confirmed by the press”.
So, “the photos show that the billboards contain stylized reproductions of the Brazilian flag and that the green and yellow colors predominate, associated with the campaign of candidate Jair Messias Bolsonaro, as is well known. The similarity for the visual identity of the advertising pieces and the themes treated with campaign slogans of the represented is undeniable”.
Finally, the minister granted those responsible 2 days to present the defense and copies of the invoices that identify the contractors of the services and those responsible for installing the advertising pieces.
