Fact check: Scholz to rejections asylum seekers to borders
In the debate about rejections at the German border, Scholz claims that rejections are legal if they refer to cases where there are no asylum applications. It is not possible with ongoing asylum procedures.
Basically, the Chancellor is correct if he says that asylum seekers cannot simply be rejected. The German Institute for Human Rights confirms that under the concept of the safe third countries, the asylum law of the Basic Law in 1993 was significantly restricted. However, whether rejections are permitted on the German border result is primarily from European law and the prohibition of rejection. This means that people who are looking for asylum must not be rejected easily. In contrast, asylum seekers are dealt with differently who have already applied for a corresponding procedure in another EU state. Then it is checked which member state is responsible for the asylum procedure. The Federal Ministry of the Interior points out that as soon as the responsibility of another EU member state is determined, which may be transferred to the state responsible for its procedure.
