The juvenile judge in Almelo has sentenced two brothers De W. (18 and 16 years old) from Wierden to the maximum youth sentences for their involvement in the death of 14-year-old Lotte. The eldest received two years of juvenile detention and juvenile tbs and the youngest one year of juvenile detention and juvenile tbs.
The brothers took the greatest good Lotte had from her, her life
Intense scenes on Thursday in the Almelo court, where the relatives of the slain Lotte heard the verdict against the two brothers from Wierden. There was massive media interest in the verdict in the high-profile case. The parents have clarity about the circumstances of the drama, in which their Lotte unwittingly plays the leading role. Emotions ran high after the sentence was pronounced. “The brothers have taken the greatest asset that Lotte had from her, her life,” said the judge when pronouncing the verdict.
The court considers it proven that the two brothers, then still 15 and 17, drove with Lotte to the Wendelgoor industrial estate on 10 January this year to punish her for sending a naked photo of the eldest brother, the so-called sexting. That punishment got completely out of hand. She was beaten and kicked and the oldest tried to strangle her. Lotte was found dead that same evening by the father of the brothers, who had come home with a story that they had seen something in the water that looked like a human being.
Biggest role for the oldest
The court is convinced that the eldest brother killed Lotte. The Public Prosecution Service (OM) pulled out all the stops to round up the burden of proof. DNA material and Lotte’s blood were found on the gloves of the eldest. This was not the case with the younger of the two. Once apprehended, the police put the two brothers together in the hope that they would talk to each other about their horrifying secret. And the two did so in full, especially about the role they had played and how they could get out of it with the least possible sentence. The conversations between the brothers were secretly tapped. Those conversations were brought into the file by the Public Prosecution Service.
The court is convinced that the brothers are jointly responsible for Lotte’s death. Together they ensured that Lotte died and together they ensured the concealment of the body. Experts did not agree on exactly how Lotte died. She was found in a ditch. Her body was covered with the grass clippings of reeds. The body showed signs of strangulation, but drowning is also a possibility that has been suggested for a long time. Lawyer Desirée Greven therefore asked for an acquittal for her client two weeks ago.
The court told what happened. Lotte was killed by strangulation. Subcutaneous bruising from punches and kicks was found on her hand, neck and limbs. Scratch injuries occurred after her death from drag. Lotte was dead when she hit the water,” she said. “Many injuries have been inflicted by falling, hitting and knocking.”
Retarded and a Disorder
Both boys are mentally retarded and have a developmental disorder, according to experts who observed them. That is why treatment in a juvenile detention center (youth tbs) is appropriate. The court agrees. In practice, it can mean that the two have to be treated for a longer period of time. Even if they are of age, the court can order that the youth TBS be converted into TBS. That means that the two won’t be walking free on the street again within a year or two.
