Electoral Law prohibits hiring during campaign period; government justifies need with end-of-year parties
President Jair Bolsonaro (PL) signed a decree authorizing the appointment of federal highway police amid the election campaign. The document was published in this Thursday (6.Oct.2022) edition of the Official Diary of the Union. Here’s the intact (79 KB).
In all, 625 candidates approved in the PRF (Federal Highway Police) contest were summoned to take the training course, which ends this Thursday (6.Oct). Those approved in the program may be immediately hired by the agency. The exact number of nominations will depend on approvals.
THE Electoral Law forbids”appoint, hire or in any way admit, dismiss without just cause, suppress or readjust advantages or by other means hinder or prevent the functional exercise and, also, ex officio, remove, transfer or exonerate a public servant, in the jurisdiction of the claim, in the three months preceding it and until the inauguration of the elected”.
However, the legislation cites as an exception to the rule the “the appointment or contracting necessary for the installation or urgent operation of essential public services, with the prior and express authorization of the Chief Executive”.
In a statement, the General Secretariat of the Presidency of the Republic states that the Ministry of Justice and Public Security considered that the demands of the electoral period, holidays and end and beginning of the year vacation justify the urgency. If the appointments do not take place, according to the Presidency, the urgent functioning of public safety and road safety activities would be compromised.
