The originally revised translate was due to enter into force by the end of 2020, but the coronavirus pandemic has slowed down preparations in the Ministry of Social Affairs and Health.

Translaki is leaving on Friday or at the very beginning of next week for a round of statements, HS sources say. It was also reported earlier Yle.

According to government sources, the government intends to suggest that the legal gender could continue to be corrected only as an adult. In addition to this, a person correcting his or her legal sex must submit a report to the Digital and Population Information Agency that he or she feels that he or she permanently belongs to the sex to be repaired. The proposal will thus largely correspond to what the governing parties agreed on in the government negotiations in 2019.

A one-month reflection period should also be waited before the legal gender can be remedied.

In the new in transla, the main difference from the current situation would be the separation of legal sex correction from the medical sex correction process. This would also remove the currently uncorrected requirement for reproductive disability for gender correction. Legal gender refers to an entry for gender found in the population register.

The legal sex has relatively few issues, such as military service and statistical and reporting obligations under the Equality Act. In addition, information on gender is used as a background in certain statutory insurance policies.

In the future, the legal sex could be corrected without any medical process involved. Nor would a medical assessment be required for an application sent to the Digital and Population Information Agency to change the legal gender in the future.

Disagreement there have been, in particular, between government parties as to whether adulthood is a necessary requirement for the correction of legal sex. The Left Alliance and the Greens have expressed the view that redress for the legal sex should also be possible for minors, such as those already 15 years old.

However, the Center has opposed this, and the Greens and the Left Alliance have not got their views on other governing parties either.

There has also been a twist between the parties regarding the details of the application process to be sent to the Digital and Population Information Agency. For example, not all parties have considered it necessary to consider the one-month reflection period included in the motion for a round.

Nevertheless, according to government sources, the draft proposal is about to go unanimously.

Originally the government’s goal was to reform the translaki by the end of 2020. However, the lack of resources in the Ministry of Social Affairs and Health caused by the coronavirus pandemic delayed reform work for more than a year.

The revised translaka is expected to be passed by Parliament at the turn of May-June after week 22. The law is due to enter into force by the end of the year, which HS sources considered a realistic timetable.

Among other things the aim of the human rights and social NGO Seta has been to translate the legal confirmation of gender based solely on self-declaration, which would be possible for those under 18 years of age.

The same has been stated in the Citizens’ Initiative, which calls for a reform of the law.
