A figure of unprecedented magnitude. If the unemployed CGT has carried out every year since 2016 a study of the offers available on Pôle Emploi, in this period of economic and health crisis, the result is cold in the back: 62.5% of the ads do not comply with the law on the site of the public establishment but also on the digital platform 1 young, 1 solution.
Between Lorient (Morbihan) and Montreuil (Seine-Saint-Denis), the activists scrutinized from January 18 to 20 654 offers in Saint-Denis (within a perimeter of 5 kilometers for the former ANPE and 10 kilometers for the site government). On poleemploi.fr, the short-lived occupations of personal service, health and construction are exploding non-compliance records. These three sectors respectively concentrate 62%, 52% and up to… 97% of illegal offers.
“Three quarters who apply are single women with children”
On the menu of the anthologies: an advertisement for a site supervisor in Saint-Denis de … Reunion, a position as a trainee lawyer, a job as a salesperson in a self-employed person or a 90-month professional development adviser contract. The CGT also flushed out temporary work assignments of 6 months which, after verification, turned out to be false offers in order to constitute a pool of human resources for the future. Same scenario in the home help sector: “They are saving labor for the future. Three quarters who apply are single women with children ”, specifies Muriel Wolfers, from the CGT local union in La Courneuve.
All these fanciful proposals, not checked upstream by a qualified Pôle Emploi agent, have very real consequences for the precarious. As Pierre Garnodier, secretary general of the CGT unemployed, reminds us: “They can serve as a basis for deregistering those deprived of employment by invoking the refusal of two reasonable offers of employment (ORE) or insufficient research. The unemployed are therefore checked on offers that do not even respect the principles of the personalized access to employment project (PPAE). “ For its part, Pôle emploi “Disputes the results of the study carried out by the CGT. In 2019, after studying 4,550 offers, 92.5% of the offers complied with the legal framework ”. The public institution adds that it “Has undertaken for several years to train its advisers to better identify illegal offers, to educate recruiters to better write their offers or even to involve its partner sites on the subject”.
“Beginners accepted” but “with experience”
But these questionable announcements continue to proliferate. Launched with great fanfare in November, the 1 young, 1 solution site alone concentrates 60% of “bogus” offers in the building sector (64%) and retail (58%). This last-born has nothing to envy to Pôle emploi. A third of the ads are for the amazing profile of “Beginners accepted” But “With experience”, while they are supposed to address 16-25 years away from work. In the retail sector, out of 209 vacancies available in Saint-Denis, 38 related to vacancies at Carrefour. But 34 of them turn out to be professionalization contracts. According to a Pôle Emploi advisor who participated in the study, the illegal aspect does not stop there: “They promise thirteenth months to bait the barge, but you have to be in the walls for at least a year to benefit from it! The announcements are even more unbridled than on the Pôle emploi site! However, they can only be legal if they properly reflect the proposed work. The government is fooling around and does not care about young people. “ Asked about these ubiquitous cases, the Ministry of Labor transferred our request for clarification to Pôle emploi because “These offers come from home”, he indicates.
For Pierre Garnodier, after years of abuses, it is time to put an end to these practices: “We called on the general management of Pôle Emploi, but they take us for dinosaurs who do not understand anything about digital technology. We seized the departmental directorates for the protection of persons (DDPP), which forwarded the file to the repression of fraud. “
