Atlético Nacional’s litigation with Cortuluá in the case of Fernando Uribe is at its highest point, following the declarations of the Purslane president, Emilio Gutiérrez, asking DIMAYOR to respect the due process and right to work of the players hired so that these can be registered to compete in the Betplay League.
Now we add the statements of the lawyer of the purslane group, the renowned jurist and former prosecutor of the nation, Néstor Humberto Martínez, who pointed out the arbitrariness of the DIMAYOR by forcing the payment of the demand and preventing the registration of the signings, Felipe Aguilar , Dorlan Pabón, Yeison Guzmán, Ruyeri Blanco and Nelson Palacios, who instituted protection actions to allow them to work, after the sanction imposed on Nacional by the Cortuluá lawsuit in the case of Fernando Uribe.
“The CAS is an arbitration tribunal and that DOES exercise jurisdictional functions. We went to the TAS and he said that we as a National did not owe Cortuluá the 5 million dollars. That is where sports justice in football matters is exhausted. However, Cortuluá violated this to the extent that this ruling was taken to an ordinary judge in Switzerland, thus ending the institutional framework established in terms of sports justice in Colombia, ”explained Martínez in the program in the RCN Play.
Before the “This is frankly disgraceful and does not admit any justification. That is why sports bodies such as Dimayor and the Federation should make sure that their sports organizations do not make it easy for them to reach out to Atlético Nacional’s patrimony, knowing that the financial situation of the clubs is already well diminished in Colombia. Lending all that institutional framework, frankly, should lead to rethinking by all authorities. If Atlético Nacional really owes that sum, what would correspond to Cortuluá would be to initiate an executive process.
“So they could give us the opportunity in that executive process to defend ourselves and show the judge that this debt does not exist, as it would happen and we would win widely. But they are going down an indirect oblique route, in my view, inappropriate and undue, which is to use the disciplinary mechanisms of football to pay for money that is not owed. That is, in a very colloquial language, we would be giving a tumbis through the institutional procedures of the Dimayor or the Federation, and that if there is no place.
“In such a way that we hope that there will be a great reflection on these issues by Dimayor and the Federation. But Cortuluá must be absolutely clear that as long as a judge does not condemn Nacional, he will not see a penny. Whatever happens ”, added Néstor Humberto Martínez.
