The Spanish Data Protection Agency (AEPD) has sanctioned the MEP Alvise Perez with 5,000 euros for publishing on his Telegram channel two photographs of the then youngest daughter of the Minister of Transport, Oscar Puente. The resolution, which also requires the images to be deleted, comes a month after a similar fine imposed on the medium EDATVdirected by Javier Negrefor related events.
The affected young woman is now preparing lawsuits against both of them, alleging illegitimate interference in their right to image. The AEPD resolution indicates that Pérez violated the General Data Protection Regulation (GDPR) by treating the privacy of the minor without respecting the principle of “data minimization”, since the photographs were not relevant or necessary for any legitimate purpose.
The investigation included seven attempts to notify Alvise at different addresses, including those registered in the Tax Agency and the Register of Seville. Given the lack of response, the AEPD published its sanctioning proposal in the BOE in June 2024.
In the publication, Pérez falsely suggested that the young woman had a romantic relationship with Puentedespite being his daughter. According to the resolution, these types of comments “imply greater severity” due to the consequences they could generate. The dissemination of images in media such as EDATV and social networks led to hoaxes of infidelity and harmful comments towards the minor.
The AEPD stressed that the publication of images of minors is not legal even if there is consent, since it prevails protection of the best interests of the minor. This reinforces the seriousness of the actions of Alvise Pérez and Negre’s media, who also received a fine of 5,000 euros in August.
Óscar Puente filed the complaints on behalf of his daughter, who was 17 years old at the time of the events. The minister publicly denounced that the publications and hoaxes provoked a negative impact on social networksdamaging his daughter’s reputation and his own.
The AEPD resolution warns that the actions of the accused constitute a serious violation of article 5.1.c of the RGPD, and reiterates the obligation to especially protect the image of minors against publications that may harm their rights and interests.
This case highlights the risk of disseminating images and data of minors in the media and networks, recalling the need to strictly comply with data protection regulations to avoid sanctions and damages to those affected.
