In the individual years “up to salary group A9, in some cases also up to salary group A10, the necessary minimum distance to basic security for job seekers is not adhered to,” the responsible 1st Senate carried out its decision. There is no constitutional justification for this.

A law enforcement officer had complained. He had opposed the salary of grade A6 granted to him from July 2016 to 2020. These are unconstitutionally too low, as they do not have the required minimum distance of 15 percent to the basic security. The action was unsuccessful in the lower instance at the Frankfurt am Main Administrative Court.
According to the VGH, not only members of salary group A are affected by the deficit. The salaries of professors according to salary group W2 would also be recorded, as this is based on the A salary. The VGH had previously determined this in a further proceeding.
