A court in Estepona (Málaga) investigates whether the mayor of the town, José María García Urbano (PP), could have committed a alleged crime of sexual harassmentas reported to Public sources from the Superior Court of Justice of Andalusia (TSJA).
The councilor assured in his X account that the complaint is unfounded, that it is “false” and that he exists and that he is “suffering” from an “unfair and inadmissible” campaign against him.
The Court of First Instance and Instruction number 5 of Estepona has initiated preliminary proceedings —those intended to know If an act is punishable and, if applicable, who would be responsible— after the complaint received by a City Council official against the councilor, according to the TSJA.
The complaint
The Efe agency reports that a local police officer He is the one who has denounced the mayor. He accuses him of sexually assaulting him and his romantic partner “under the threat that he could lose his job as a civil servantsince it depended on him.”
According to the complaint, which consists of seven pages and to which EFE has had access, the councilor contacted the police agent daily to satisfy his sexual desires. The alleged victim began working at the City Council in March 2022 as a trainee official and from the first moment he felt that the mayor had special treatment for him and that “I was looking for a libidinous intention towards him“.
The complainant maintains in the complaint, according to Efe, “that He had no choice but to agree to the mayor’s sexual demands.” since he was “afraid of losing his job,” because García Urbano supposedly always made it clear to him.
For the moment, judicial sources said, the only agreed diligence by the investigating judge “is to take the complainant’s statement at an early date.” Then, based on the evidence of crime that can be collected, “the next steps to be taken will be decided,” the sources said.
The official’s complaint was presented last October 23 at the Deanery of the Courts of Estepona and was later transferred to Court number five.
“Unfair campaign”
The mayor, given the dissemination of information about the complaint, has decided “put the matter in the hands of a team of lawyers that he is going to appear in the procedure in order to request that he be heard, voluntarily and as soon as possible, to demonstrate the absolute lack of foundation of said complaint”, according to Europa Press.
“It is a unacceptable and unfair campaign to damage personal dignity and the career of the mayor and the position he holds with a single and clear spurious purpose,” he assured in a communication.
