A girl accused a young man of seizing 31,000 dirhams, which she said she transferred to the account of his sister’s sons at his request. The Abu Dhabi Court for Family and Civil and Administrative Claims ruled to reject the case because the papers were devoid of any evidence of the validity of the plaintiff’s allegations.
The girl had filed a lawsuit against the young man, demanding, at the end of it, to oblige him to pay her the amount, noting that he asked her to transfer it to the account of his sister’s sons, as a way of fidelity to him, but he did not return it to her, and attached pictures of the “WhatsApp” conversations between them, while The defendant was absent from attendance despite his announcement.
In the rationale for its ruling, the court indicated that the decision, according to the Evidence Law, is that the plaintiff must prove his right and the defendant has to deny it, and that the burden of proving the alleged right falls on the one who adheres to it, noting that the lawsuit papers are devoid of any evidence of the validity of what the plaintiff claims.
It also did not request an investigation into the merits of the case, and the court ruled to dismiss the case.
