The Court of Pontevedra has confirmed the sentence that imposes a sentence of 11 months in prison on a man and the loss of parental authority for shooting his nine-year-old daughter several times with a toy pistol, causing bruises on her legs. The court has rejected the arguments of the father, who argued that he had done it to “correct the girl’s attitude towards her sister” and “set an example for her”, and considers the defendant to be the perpetrator of a crime of minor injuries in the field of domestic violence.
The ruling thus considers the sentence that was imposed on her at the time by the criminal court number four of Pontevedra to be “proportionate”, and rejects the appeal filed by the father who tried to justify the facts, stating that he did not attack her, and that the incident occurred after the little girl accidentally wounded her older sister with the gun.
The final judgment considers it proven that on December 29, 2019, while the two girls were in the care of their father, the minor, nine years old, accidentally injured the eldest, 10, by firing a rubber bullet from a pistol. toy. Upon learning what happened, the ruling recounts, the father “began to hit” the girl “with an open hand” and, later, “shot her in the legs with the toy gun several times at a short distance”, hitting her in eight or nine times with the plastic bullets. As a result, the girl had several bruises, according to the medical report.
In his appeal, the father maintains that he had not hit the girl, although he admitted having shot her with the toy gun “from a distance” to “correct her attitude” and without “intention to injure her”. However, the Court has responded emphatically and considers that the facts have been amply accredited, while criticizing some contradictions in which the father has incurred in explaining the facts. The court refers specifically when the father says that he did not intend to harm the minor, but recognizes that the objective of his action was “to make her see that he could harm her sister.”
In addition to the prison sentence and the withdrawal of parental authority, the sentence disqualifies the accused from having or handling weapons for two years. In the same way, he will not be able to communicate or get close to his daughter for two years, nor have visitation rights for a period of three years.
