The Criminal Chamber of the National Court has corrected the judge of the Punic case, Manuel García-Castellón, and has annulled his decision to divide the investigation into box b of the PP in Madrid in two. The court thus reorganizes the planning arranged by the magistrate and considers that the initiative it took is “unnecessary and useless”, in addition to “complicating” a long investigation that has lasted seven years and that currently maintains two former presidents of the Community charged. from Madrid, Esperanza Aguirre and Ignacio González.
Last May, García-Castellón decided to detach from the line of investigation on irregular financing – the one baptized as Piece 9 – all the revelations provided by the former mayor of Majadahonda, Guillermo Ortega, alias The rat. The popular ex-mayor, sentenced to more than 40 years in prison for his involvement in the Gürtel plot, said that Aguirre placed him in charge of the public company Mercado Puerta de Toledo, from where he diverted more than one million euros to pay expenses of the electoral campaigns of the formation. According to Ortega, who provided invoices and asked for time to collect more material, the president was aware of the irregularities and even congratulated him on his illegal work.
More tests
The Punica instructor wanted to separately investigate Ortega’s revelations and, to do so, created Piece 13 and asked to collect more evidence. In addition, he made this decision after the Chamber had urged him to close the investigations on box b of the Madrid PP, which have been open for years and which he himself considers exhausted for months.
But the Prosecutor’s Office and the popular accusations appealed that measure. As they argued, parts 9 and 13 really deal with the same issue – the alleged box b of the PP – and, therefore, they cannot be instructed separately. Some allegations now accepted by the Criminal Chamber, as recorded in a decree dated December 1, which concludes that Ortega’s revelations “fall within the same object of the investigation” on box b.
The court’s decision erupts when Piece 9 was facing its final phase. The Prosecutor’s Office has already advanced that it was preparing its final report on this line of investigation, where it would detail all the evidence collected and will announce whether it asks that Aguirre be sent to the bench.
