A popular jury is scheduled to try starting this Monday, December 16, a man for whom the Prosecutor’s Office of Malaga requests 13 years in prison by accusing him of allegedly kill a young man with nine stab wounds who went to his house in the capital of Malaga supposedly to buy him drug.
The events occurred in 2022. According to the prosecutor’s indictment, months before April the victim, who was a university student and who lived with his parents in a neighborhood of Malaga, contacted the accused after falling into the substance use narcotics.
Both had contact due to the purchase of said substances, so financial debts arosewhich is why another judicial procedure is followed. One day in April, the young man went with a friend to the defendant’s home “supposedly to acquire a narcotic substance and discuss matters related to this.”
The friend entered first and originated a strong discussion with the accused for undetermined reasons, during which “they attacked each other with strong blows, punches and kicks”, so that they suffered minor injuries, says the public accusation. After this, the young man entered and intervened in the fight.
At a certain point in the discussion, when everyone was at the entrance, the person under investigation, “after having taken from the kitchen a 22 centimeter knife long and four wide with the intention of ending his life”, he allegedly stabbed the young man several times, says the Prosecutor’s Office, which caused nine wounds by knife.
The victim, according to the prosecutor’s office, put his arm in to try to defend himself, although he suffered “numerous injuries in the chest, head, arm and right forearm, one of these stab wounds penetrating the lung and heart.” Despite the severity of the injuries, the young man and his friend fled.
They were allegedly chased by the defendant, who was brandishing the knife, although he did not locate them, the provisional document says. Seeing that they were gone, the accused hid at homechanged his clothes, cleaned the knife and threw it in the trash can, in addition to throwing the drugs on the roofs of the neighboring buildings.
While the friend fled, “ignoring any type of medical and human attention, despite coinciding with a 061 health worker” who had come for another emergency; the young man, “seriously injured” and “without help from anyone”, managed to get down to the portal where he fainted and died despite being assisted by the health worker who was unable to revive him.
The Police went to the defendant’s home and, after repeated calls without him opening the door or requesting help, they entered by force and found the defendant lying on the floor with various minor injuries fruit of the previous fight. In addition, the agents found the knife and blood-stained clothing.
For the prosecutor, it is a crime of homicide of which he accuses the defendant for whom he requests that a sentence of 13 years in prison be imposed and the payment of 200,000 euros to the victim’s heirs.
