This Thursday, the Ministry of Labor will bring to the Council of Ministers for approval a package of labor and risk prevention measures that contemplate the modification of the Workers’ Statute to include a new paid leave with which to protect the right to be absent from work in the event of catastrophesas reported to Europa Press by sources from the Department directed by Yolanda Díaz.
Specifically, what Labor calls will be incorporated into the Workers’ Statute. ‘climate’ permits: up to four days of paid leave for the worker due to the impossibility of going to the workplace in the event of a catastrophe, extendable until the circumstances that motivated it disappear.
If more days are necessary, companies could use a Temporary Employment Regulation File (ERTE) of force majeure for its justification.
The labor measures that the Council of Ministers plans to approve this Thursday also contemplate the right of workers to be informed of the actions planned due to the activation of disaster alerts.
It will be mandatory for all collective agreements negotiate action protocols that include measures to prevent occupational risks in the face of catastrophes and adverse meteorological phenomena.
In the event of serious and imminent risks, the company will be obliged to inform as soon as possible of the measures to be adopted and give instructions to interrupt the activity, which will be suspended until the danger subsides.
Unions may agree to paralyze activity
Likewise, Labor has designed a “new green right”, by which the legal representatives of the workers or, failing that, the prevention delegates, may agree to the cessation of the activity to avoid risks to the workforce.
Sources from the Ministry have made it clear that workers will not be able to suffer any harm from the adoption of all these measures.
The Department headed by Yolanda Díaz will approve within one year the regulations on the protection of workers against the effects of climate change in the workplace.
