The Provincial Court of Seville has sentenced the former general secretary of UGT in Andalusia, Francisco Fernández Sevilla, to three years in prison and the payment of a fine of 50 million euros for falsifying a commercial document in a media competition with the crime of subsidy fraud.
The court considers it proven that Fernández “consciously and fraudulently” applied 40 million euros received from the Junta de Andalucía to carry out training courses for unemployed and employed people for “different purposes.”
With them, UGT financed, according to the Court, the union’s own activities, “unrelated to the social purpose for which they received” the aid. The sentence is not final and can be appealed in cassation before the Supreme Court.
Along with Fernández, the former deputy general secretary of administration of the union, Federico Fresneda, has been sentenced to the same penalties; the former secretary of economic management, María Charpín, and the then CEO of the Soralpe entity Enrique Goicoechea.
The Court also condemns the person responsible for the UGT Purchasing Department, Dolores Sánchez, although in this case as an accomplice to the crimes and imposes six months and two days in prison, and a fine of 25 million euros.
All of them have also been sentenced to the loss of the possibility of obtaining subsidies or public aid and the right to enjoy tax or Social Security benefits or incentives for a period of one and a half years.
