The Government is preparing an economic shield for companies, self-employed workers and workers affected by the impact of DANA, which will be detailed in a few minutes by Second Vice President Yolanda Díaz after meeting with union and business representatives of the Valencian Community. Sources from the Ministry of Labor advance that companies will be able to benefit from the Erte due to force majeure with a deduction of at least 90% of social contributions. Self-employed workers, for their part, will have more flexible access to cessation of activity, the benefit that works like ‘unemployment’ for this group. The Executive wants to reinforce teleworking or compensate for absences to avoid unnecessary trips.
The temporary employment regulation files (ERTE) due to temporary force majeure are due to a stoppage in the company’s activity motivated by “involuntary, unpredictable facts or events, external to the circle of the company that temporarily make work activity impossible,” as explained Job. This first point is justified by the impact of DANA in the Valencian Community and, specifically, in the most affected area, Horta Sud.
A planned bonus in the payment of social contributions of 90% and even 100% from which companies can benefit. In any case, the Government conditions the disbursement of public money on the protection of staff, prohibiting layoffs.
The self-employed have a specific system of protection for cessation of activity, the equivalent of the ‘unemployment’ of employees, and it can be temporary or permanent. To facilitate your access, Social Security will not take into account the need to prove contribution periods when calculating the time that you will be able to receive the benefit.
This protection includes the payment of a monthly financial benefit for cessation of activity, and Social Security contributions for common contingencieswith particularities in certain cases.
The Government also wants avoid risks to your health, non-essential travel or labor reprisals in the face of difficulties caused by the catastrophe (for example, punctuality or on-site work). They will legally reinforce these situations so that the worker is not forced to go to work if his health is at risk in the following cases that the minister advanced with a detail, the absences will be paid:
- If moving puts your safety at risk or interferes with rescue and recovery efforts, and your activity is incompatible with teleworking.
- If you have to care for missing relatives or take care of the death of someone in your family.
- If you have lost your home or belongings and are not able to go to your workplace.
- If you have to deal with caring for family members as a result of the closure of schools, residences or public services in general.
